The introduction of tougher policing powers in 2022 has had a negative impact on the ability of Gypsies and Travellers to continue a nomadic way of life, free from discrimination and arbitrary treatment. 

In taking a stand, you are not alone—time and time again national and international human rights bodies have come out against Part 4 of the PCSC Act: 

  • The High Court issued a Declaration of Incompatibility on Part 4, finding that elements of it discriminate against Gypsies and Travellers and breach Article 14 rights when read with Article 8 of the European Convention on Human Rights.
  • The Council of Europe Commissioner for Human Rights, the Joint Committee on Human Rights, the UN Committee on the Elimination of Racial Discrimination, and the UN Committee on Economic, Social and Cultural Rights have all raised concerns or made formal recommendations to the UK Government to repeal Part 4 of the PCSC Act.
  • The majority of police forces and Police and Crime Commissioners oppose the criminalisation of trespass under Part 4.

It's no longer up for debate—Part 4 should be no more.
